Contract? Empty Contract?

Post by fifilefemme Sat Jan 14 2012, 19:51

Has anyone had to draw up a contract for transfering a dog from one person to another. We have had a phone call this evening from the Ex partner of the lady who wants us to have her staffie telling us to get her to bring the dog to him. We run one of the local pubs and know of this guy, though he's not a frequent customer anymore, but he may try & cause trouble. Dilema. My daughter is going to be in bits if this all falls through but I don't want any agro from him either. One of my staff suggested getting a contract drawn up if it all goes ahead. Agghh headache.

Write up a very basic agreement and get it signed. Its then a contract.

It can still cause agro though, are they going to try and take the dog back once you have it?

i think it would be a good idea to see if the dog is kk registered if so and he the registered owner if he wanted the dog back i dont think you would have a leg to stand on in the ownership sorry to be negative Sad

She's not KK registered I know. Contract not a problem then, just him. Hopefully she will be able to make him see with his MS and drinking he could not cope with the dog but he could come & visit her at our pub. We are only trying to help them out. I'd be quite happy to wait a while longer, not sure my daughter will agree though.

I think registering would be a good idea. Also try to have a talk with the guy and let him know he can come and visit the dog whenever he wants and that you are just trying to do what is best for the dog. This should prevent any problems in the future.

Hope it works out for you.

I don't know how true this is although getting a signed contracte would be ideal...i've been told if a Dogs not micro-chipped and the owner as it done such as yourself..lady being in your hands then the dog is legally yours, that might be worth looking into also if she's not been chipped.

Who owns the dog?

This is the question you must have an answer to, as if the dog legally belongs to the ex partner then no number of contracts between you and the lady will be valid.

Find out who bought the dog, who cared for it as primary carer, who paid for its food, vets bills etc.

Going to try & sort it out today. She has been the primary carer, bought the food etc. But she is not neutered or chipped, which would be the first thing I would do. I just hope he can see that this way he can still see her but nor have to worry about looking after her day to day, just concentrate on his illness and getting through this breakup in his lifebvwithout punishing everyone around him.

A rescue has 7 days were the dog is classed as stray after 7 days the law says they can rehome and if the owner comes forward to reclaim then its too late. The law says the same in private owners too so if you had her for 7 days proof would be good (reg in vets, contract, receipts for food ect, microchip, enquiry for neuter) then she would become your dog Smile
